Hospital price transparency just got real. And most hospitals are not ready.
When CMS rolled out price transparency rules in January 2021, the industry found a workable response: post a machine-readable file somewhere on the website, make it technically compliant, and move on. Penalties were small. Enforcement was minimal. The calculus favored minimal effort.
That playbook no longer works in 2026.
CMS has escalated enforcement significantly. Civil monetary penalties now reach up to $2 million per year for large hospitals that fail to meet the standard. Federal auditors are actively reviewing posted files for completeness, accuracy, and accessibility — not just existence.
